上次剛剛說了下Axios的消息,要求學(xué)生在美國學(xué)習(xí)2年或者4年后需要重新審查,還沒幾天,靴子這次又掉下來了。

9月24日,美國國土安全部DHS正式宣布了提案,要求改變國際學(xué)生,交流訪問學(xué)者和外國媒體代表在美國停留的時間,計劃將F、J類非移民簽證的合法停留時間限制為2年或者4年。國土安全局表示,這是為了鼓勵合規(guī)性,減少欺詐行為,說白了,各種疑心病發(fā)作。

國土安全不還把離境時間從60天縮短到30天;向?qū)で笱娱L居留的F,J和I類非移民收集生物識別數(shù)據(jù)。

記住,這只是一個提案!提案!提案!

沒有通過,目前是公示期,從9月25日開始,為期30天公示,任何人都可以發(fā)表意見,留言。最后美國政府會根據(jù)收集的意見和留言來做決定。

這個政策如果出臺,對留學(xué)生自然是很不利的!我去了可以遞交評論的公告鏈接點:

這里面竟然可以選國別,中國也有,我竟然也能參政議政,自然投了一票,大家有機會也去發(fā)表一下自己的意見,呵呵,感受下美式文化!

其實,學(xué)校也已經(jīng)跳起來發(fā)表意見了,斯坦福的媽媽最早拿出了斯坦福的信息,強烈反對!

Stanford statement on proposed visa-duration rule

Stanford will strongly oppose a proposed federal rule issued Friday by the Department of Homeland Security, which would have wide-ranging effects on international students and scholars who hold F or J visas.

Currently, international students and scholars are allowed to remain in the United States for the full length of their program. If the proposed rule is made final, it would mean that the U.S. no longer commits to allowing them to stay for the full duration of their studies.

“While we understand the national security issues referenced in this proposal, this is another in a series of policies that make the U.S. less welcome to our international community – to the detriment of our international students and scholars, our universities, and our country’s scientific leadership and long-term economic competitiveness,” said Stanford President Marc Tessier-Lavigne. “The proposed rule creates additional stress and uncertainty for international students, scholars and their families, and for all who dream of pursuing their education in the United States, now and in the future.”

The proposed rule would allow F and J visa holders to remain in the United States for four years, with the possibility of extension. Several groups would be limited to two years only, including non-immigrant students who were born in or are citizens of countries on the State Sponsor of Terrorism List, those coming from a country with a high “overstay” rate, and those affected by a U.S. National Interest trigger, which may include national security concerns or risks of fraud or abuse. Students and scholars would need to apply for an extension of status in order to complete their program, if it extended beyond the allotted time.

At Stanford, PhD students and postdocs would be the populations most impacted if the proposed rule is made final in its current form. The proposed rule will not impact current F or J visa holders who were admitted for “Duration of Status” for the next four years after the effective date of the final rule. It will not impact members of the community already subject to date-specific admission.

“These proposed changes are deeply troubling,” Tessier-Lavigne said. “Stanford will strongly advocate against this policy before the Executive Branch and Congress, in partnership with our national associations and peer institutions. We will also do everything we can to support our students in navigating this policy, should the proposed rule become final.”

哈佛說的比較淡定,這啥還沒執(zhí)行呢,還有30天,大家不要急,我們在分析對付它,有消息我們馬上告知!

Proposed DHS Rule Regarding Duration of Status

September 25, 2020

As many of you may have heard, the U.S. Department of Homeland Security (DHS) published a proposed rule today to eliminate duration of status (D/S) for F-1 students and their F-2 dependents, and J-1 exchange visitors (including students, researchers/professors, and short-term scholars) and their J-2 dependents.  The proposed rule would eliminate D/S, and individuals entering the U.S. in F or J status would be admitted for a specified length of time with options and procedures for extensions.

Please note that NOTHING has changed yet.  This is a proposed rule.  The public has 30 days to comment on this proposal.  DHS will then consider the comments and publish a final rule with an effective date.  A number of offices around the University are working on analyzing this proposal and will work with colleagues at our peer institutions and professional associations to advocate on behalf of all our international students and scholars.  We will share updated information as soon as possible.

USDHS Publishes PROPOSED Rule Impacting Period of Admission for F, J, and I Visa Status

On September 25, 2020, the US Department of Homeland Security (USDHS) published a Proposed Rule to change the period of admission to the U.S. for F and J students and exchange visitors, and I status for representatives of foreign media, from Duration of Status “D/S” (the duration of the academic program or media assignment) to a fixed period of stay.

The Proposed Rule does not take effect immediately. Rather, it is notice from USDHS of a contemplated change, and provides a 30-day period for public comment, after which a final rule may be published. MIT, its peer institutions and professional associations representing higher education and international exchange are carefully examining the Proposed Rule and will submit comments to USDHS.

普林斯頓的國際辦公室老大認真給國際生寫了信,真是說到面面俱到,考慮周全。特別之處了變化以后說了重要的3點。

1. 這個提案目標沒有影響到你。

2. 希望有多人去提意見,反對它,這樣導(dǎo)致改變。

3. 對于H-1B,O-1,TN, E-3等簽證的人沒有影響。

佩服這位領(lǐng)導(dǎo),也難怪普林斯頓能夠一直排在榜首!感動!考慮真心周全!

To our International Students and Scholars, 

The U.S. Department of Homeland Security (DHS) published a proposed rule today that, if implemented, would eliminate Duration of Status (or D/S) admission for international students, scholars, and dependents holding F and J visas. The proposed rule would replace D/S designation with a fixed time period of either two-or-four years upon admission to the U.S. Under current regulations those admitted for D/S can have their programs extended by their visa sponsor without the need for filing a request with the government. Under the proposed rule this process would be replaced by a requirement to file an extension of stay directly with U.S. Citizenship & Immigration Services (USCIS). Another significant change is the proposal to eliminate the 60-day grace period for F-visa holders and replace it with a 30-day grace period to align with what is currently granted to J-visa holders. The proposed rule includes an OPT change by increasing the number of days applicants have to file prior to the program end date from 90 days to 120 days.

Important Points: 

· A proposed rule does not impact your immigration status. If you are currently a F-or-J visa holder at Princeton, and were admitted for Duration of Status, that has not changed. You remain in D/S. 

· We expect numerous comments to be filed relating to the proposed rule. This could lead to changes in the proposed rule. 

· This proposed rule does not impact members of the Princeton community already subject to date-specific admission (i.e., H-1B, O-1, TN,  E-3, and any dependents holding derivative visas).
